The Ministry of Justice has confirmed that the proposals made last year for increasing probate fees are likely to go ahead. The proposal by The Ministry of Justice stated that Probate Court Fees (which is currently £155.00 for professional applications and £215 for non-professional applications) will be determined by a sliding scale/banded structure where fees increase in line with the value of the estate.

The proposed probate application fees are as follows:

  • £300 for estates worth more than £50,000 and up to £300,000
  • £1,000 for estates worth more than £300,000 and up to £500,000
  • £4,000 for estates worth more than £500,000 and up to £1 million
  • £8,000 for estates worth more than £1m and up to £1.6 million
  • £12,000 for estates worth more than £1.6m and up to £2 million
  • £20,000 for estates worth more than £2 million

It is proposed that the change in fee structure is projected for May of this year, although the change as not yet been confirmed to go ahead.

By becoming an Associate with us at APS Legal and Associates, you can help clients state their wishes in their Will as well as assist the family at the Probate stage. You will also be able to be competitive for Probate fees compared to banks and building societies.

As an Associate, you will educate your clients on these services, keep in contact with them throughout the case, take instructions and we will act as an ongoing back office support for you.

There are two levels to membership:

  • Estate Planning and Will Writing Associate
  • Probate Associate

These are separate training courses but both memberships can be obtained.
